The Failure of the 28-Article Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis caused by the presentation of a new 28-point plan for resolving the conflict appeared – briefly – to have been stabilised. A senior US official spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Moscow made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, diplomatic battles are fought: optimistic declarations are released from multiple capitals. Immense energy is devoted on containing specific proposals. By night, Moscow brutally reminds the world that, for them, military action persists as the key method for achieving "peace".

After-Dark Attacks

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is capable of detecting missile launches from Russian territory, a ability provided through current data. From vantage locations, military aircraft that had been deployed to counter approaching cruise missiles roared overhead – modern combat jets delivered to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons engaged: several firings fired to intercept a hostile projectile. This was a sophisticated defense system at work, presumably provided by allied countries. Every firing creates sudden vibrations, rattling buildings. The instant of fear quickly gives way to sober acceptance: possibly the hostile projectile won't cause damage this time, preventing destruction from ruin and another blackout.

Persistent Threats

Soon after, a automatic firearm opened up on a aerial vehicle somewhere nearby, part of a rapid response unit – almost certainly imported technology. Sadly, the bullets missed the hostile drone – it continued its flight toward its target.

Periodically, this carried on until dawn. Kyiv awoke to the early updates: multiple fatalities, damage and heating outages in many homes as a result of the night's assault. As always, everyone still went about their day – living the war. But those full day encapsulated Ukraine's vital need on Western support – a need that regional partners are demonstrably unable to replace in the near term.

Ineffective Peace Efforts

The detailed framework from Washington generated strong feelings, debate and deep concern – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after earlier high-level meetings and multilateral gatherings.

Every new approach from Washington adheres to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually achieve victory. This cycle will, no doubt, persist.

Strategic Calculations

It is convenient to criticize specific actors of persistently promoting Kremlin's demands. But that does not seem to be the whole story. US administration functions according to a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The US administration believes that it is impossible to force Russia to abandon the territory that it currently occupies in Ukraine's occupied territories.

The issue is that while acknowledging this situation, Washington does little to prevent Kremlin actions, through diplomacy or military means, from thinking that the situation will not shift further in its advantage in the near future.

Opposing Positions

Therefore, Russian leadership is confident that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their motivation to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will carry on as long as Russia's leadership remains supremely confident in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still endure, gradually sacrificing civilians and areas but avoiding a complete military breakdown until situations evolve in its favour.

Existing Situation

Realistically, there are no genuine requirements for a armistice. Now, personal considerations are entering the equation: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the flag against any proposal Kyiv finds unsuitable, so that their priority does not shift toward internal issues. And although their mission will now be significantly challenging after latest incidents, it remains very improbable that this will modify their basic position.

These opposing factors are guiding negotiations.

Summary and Prospects

It took a just a single week to eliminate the 28 points of the latest plan. Forceful and unpredictable management of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with pacifying measures of negotiators, and finally, recent disclosures, all did their job.

While new plans based on previous concepts are approaching, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and show certain reluctance to modify developments, if they maintain solidarity and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the coming months, largely rely on ongoing international assistance.
