The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and status as a newcomer motivated his push for 23XI Racing to confront Nascar over perceived violations of competition laws.
Team Investment and a Competitive Drive
The owner disclosed operational insights of his racing venture, saying he invested $40m of his personal wealth into the Cup Series operation launched with partner Polk and driver Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”
The Core Dispute: Charter Agreements and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a “charter”. This deal was due to end in 2024 when Nascar demanded teams renew their charters.

Heather Gibbs detailed her push for indefinite franchises, submitted in a written letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, that’s the number.”
