US Judge Orders Freedom of Abrego Garcia from ICE Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her decision, the judge pointed out that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
